1. WELCOME

Your privacy is important very important to us. This privacy policy (the “Privacy Policy”) applies to all websites (such as https://humantelligence.com), mobile application (“Apps”), any and all HT URLs, and/or any related services, sales, marketing or events (collectively, with the Apps, the “Sites”) owned or operated by Humantelligence Inc. and/or one of its parents, subsidiaries, or affiliated companies (collectively, the “Company,” “HT” or “we” or “us”).

This Privacy Policy applies to all information collected through our Sites, including but not limited to, the Apps, and the HT services and content provided on or through the Sites and/or accessible through various desktop and mobile web browsers, locally installed mobile web applications, and various API services and other content and services that HT may offer from time to time (all of the foregoing including the Sites are collectively referred to as the “Services”).

This Privacy Policy describes the information about you that HT collects through the Services and how this information is used, maintained and, in some cases, shared. HT values your use of the Services and is committed to protecting your privacy. HT shares your information only as described in this Privacy Policy. HT has provided this Privacy Policy to assist you in understanding the information that we collect, how we use it and the ways we maintain it, including the security of your personal information. By visiting or using the Services, services, applications and any other pages, applications, features or content on the Services, you acknowledge that you accept the practices and policies outlined in this Privacy Policy.

This Privacy Policy applies only to information that you provide to HT while visiting or using the Services, and does not apply to any information that HT has received, obtained or may obtain through third parties, offline or through other means.

2. GENERAL INFORMATION COLLECTED

In order to enhance the content contained on the Services, HT may gather and store certain information about your visit. “General Information” is information about you or your activities through which you cannot be identified. This information may include some or all of the following items:

  1. The Internet Protocol (“IP”) address of your Internet Service Provider (“ISP”) and/or your computer, if it has its own static IP address. The domain name may also be collected. Your IP location information may be used during your visit to the Services to serve you location specific information or advertisements for goods or services available in your specific location, however, such information will not be collected or maintained by HT except in aggregate form.

  2. The date, time, length of stay and specific HT web pages, images, documents or forms accessed by you at such Services.

  3. Whether you are viewing any of the Services for the first time, or are a return visitor.

  4. The Uniform Resource Locator (“URL”) of the website or advertisement that referred you to any of the Services.

  5. The search engine that referred you and any search strings or phrases entered into the search engine to find any of the Services.

  6. Demographic information concerning your country of origin and language(s) used.

  7. The type and version of the Internet browser used to visit any of the Services, the operating system on your computer and information regarding errors when viewing any of the Services.

HT collects this General Information and may use it to generate aggregate statistics about visitors to and users of the Services. In situations where it is possible to do so, General Information may be linked to personal information.

3. WHAT INFORMATION DO WE COLLECT?

Personal information you disclose to us We collect personal information that you provide to us such as name, address, contact information, passwords and security data, payment information, and social media login data.

We collect personal information that you voluntarily provide to us when registering at the Sites or Apps, expressing an interest in obtaining information about us or our products and services, when participating in activities on the Sites or Apps (such as posting messages in our online forums or entering competitions, contests or giveaways) or otherwise contacting us. The personal information that we collect depends on the context of your interactions with us and the Sites or Apps, the choices you make and the products and features you use. The personal information we collect can include the following:

  1. Name and Contact Data. We collect your first and last name, email address, postal address, phone number, and other similar contact data.

  2. Credentials. We collect passwords, password hints, and similar security information used for authentication and account access.

  3. Payment Data. We collect data necessary to process your payment if you make purchases, such as your payment instrument number (such as a credit card number), and the security code associated with your payment instrument. All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions.

  4. Social Media Login Data. We provide you with the option to register using social media account details, like your Facebook, Twitter or other social media account. If you choose to register in this way, we will collect the Information described in the section called “YOUR SOCIAL LOGINS“ below.

All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information.

Information automatically collected Some information – such as IP address and/or browser and device characteristics – is collected automatically when you visit our Sites or Apps.

We automatically collect certain information when you visit, use or navigate the Sites or Apps. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Sites or Apps and other technical information. This information is primarily needed to maintain the security and operation of our Sites or Apps, and for our internal analytics and reporting purposes.

Information collected through our Apps

We may collect information regarding your geo-location, mobile device, push notifications, when you use our apps. If you use our Apps, we may also collect the following information:

  1. Geo-Location Information. We may request access or permission to and track location-based information from your mobile device, either continuously or while you are using our mobile application, to provide location-based services. If you wish to change our access or permissions, you may do so in your device’s settings.

  2. Mobile Device Access. We may request access or permission to certain features from your mobile device, including your mobile device’s camera, contacts, social media accounts, storage, and other features. If you wish to change our access or permissions, you may do so in your device’s settings.

  3. Mobile Device Data. We may automatically collect device information (such as your mobile device ID, model and manufacturer), operating system, version information and IP address.

  4. Push Notifications. We may request to send you push notifications regarding your account or the mobile application. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.

Information collected from other sources We may collect limited data from public databases, marketing partners, social media platforms, and other outside sources. We may obtain information about you from other sources, such as public databases, joint marketing partners, social media platforms (such as Facebook), as well as from other third parties. Examples of the information we receive from other sources include: social media profile information (your name, gender, birthday, email, current city, state and country, user identification numbers for your contacts, profile picture URL and any other information that you choose to make public); marketing leads and search results and links, including paid listings (such as sponsored links).

If a third party has provided you access to the Services, then we will share your personal information with that third party, and you expressly agree that we may do so. Once your personal information is provided to your company, your company’s privacy policy will then control, and we will no longer be responsible for the personal information provided to your company. This Privacy Policy excludes data that may be stored or transmitted to or from the service provider hosting the Services.

4. PERSONAL INFORMATION USE

We process your information for purposes based on legitimate business interests, the fulfillment of our contract with you, compliance with our legal obligations, and/or your consent. We use personal information collected via our Sites or Apps for a variety of business purposes described below. We process your personal information for these purposes in reliance on our legitimate business interests (“Business Purposes”), in order to enter into or perform a contract with you (“Contractual”), with your consent (“Consent”), and/or for compliance with our legal obligations (“Legal Reasons”). We indicate the specific processing grounds we rely on next to each purpose listed below. We use the information we collect or receive:

  1. To facilitate account creation and logon process with your Consent. If you choose to link your account with us to a third party account *(such as your Google or Facebook account), we use the information you allowed us to collect from those third parties to facilitate account creation and logon process. See the section below headed “YOUR SOCIAL LOGINS“ for further information.

  2. To send you marketing and promotional communications for Business Purposes and/or with your Consent. We and/or our third party marketing partners may use the personal information you send to us for our marketing purposes, if this is in accordance with your marketing preferences. You can opt-out of our marketing emails at any time (see the “YOUR PRIVACY RIGHTS“ below).

  3. To send administrative information to you for Business Purposes and/or Legal Reasons. We may use your personal information to send you product, service and new feature information and/or information about changes to our terms, conditions, and policies.

  4. To post testimonials with your Consent. We post testimonials on our Sites or Apps that may contain personal information. Prior to posting a testimonial, we will obtain your consent to use your name and testimonial. If you wish to update, or delete your testimonial, please contact us at [email protected] and be sure to include your name, testimonial location, and contact information.

  5. Deliver targeted advertising to you for our Business Purposes and/or with your Consent. We may use your information to develop and display content and advertising (and work with third parties who do so) tailored to your interests and/or location and to measure its effectiveness.   6. Request Feedback for our Business Purposes and/or with your Consent. We may use your information to request feedback and to contact you about your use of our Sites or Apps.

  7. To protect our Sites for Business Purposes and/or for Legal Reasons. We may use your information as part of our efforts to keep our Sites or Apps safe and secure (for example, for fraud monitoring and prevention).

  8. To enable user-to-user communications with your Consent. We may use your information in order to enable user-to-user communications with each user's consent.

  9. To enforce our terms, conditions and policies for Business Purposes and/or for Legal Reasons.

  10. To respond to legal requests and prevent harm for Legal Reasons. If we receive a subpoena or other legal request, we may need to inspect the data we hold to determine how to respond.

  11. For other Business Purposes. We may use your information for other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Sites or Apps, products, services, marketing and your experience.

We may make chat rooms, message boards, blogs, and other community services available to you on the Services. Please understand that any information that is disclosed by you in these areas becomes public information. When you disclose such information in a chat room, message board, blog or any other public forum, you do so at your own risk. We have no control over its use and you should exercise caution when deciding to disclose your personal information or any other information about yourself. The information presented in these areas reflects the views of the individual users or hosts and does not necessarily reflect the views of HT or any of its affiliates. We reserve the right (but has no obligation) to monitor the use of chat rooms, message boards, blogs or other public forums on the Services.

HT may also disclose your personal information if: (a) your information is subject to disclosure in response to judicial or governmental subpoenas, warrants or orders served on HT; (b) your information is subject to disclosure to protect HT’s rights or property, to enforce the provisions of this Privacy Policy and/or HT’s Terms of Use and/or to prevent harm to yourself or to another; or (c) your information is subject to disclosure or transfer if HT or its business is sold or offered for sale to another entity or individual(s), a petition for relief is filed under U.S. Bankruptcy laws for or against HT or if HT becomes subject to an order of appointment of a trustee or receiver. We reserve the right to release and/or use all information contained within our databases, access logs or other records concerning you if you violate this Privacy Policy, our Terms of Use or other rules, policies, notices, agreements or guidelines, or if you intentionally or unintentionally partake (or are reasonably suspected of partaking) in any illegal activity, including but not limited to hacking, even without a subpoena, warrant or other court order, and to release such information in response to court and governmental orders, civil subpoenas, discovery requests and as otherwise required by law and/or to initiate our own legal proceedings. HT cooperates with law enforcement agencies in identifying those who may be using the Websites (or any part thereof) for illegal activities. HT also reserves the right to report any suspected illegal activity to law enforcement individuals or to entities for investigation or prosecution.

HT may take your personal information and make it non-personally identifiable, either by combining it with information about other individuals (aggregating your information with information about other individuals), or by removing characteristics (such as your name) that make the information personally identifiable to you (de-personalizing your information). Given the nature of this information, there are no restrictions under this Privacy Policy upon the right of HT to aggregate or de-personalize your personal information, and HT may use and/or share with third parties the resulting non-personally identifiable information in any manner in HT’s sole discretion.

5. MAINTENANCE OF PERSONAL INFORMATION

If you have an account with HT (an “Account”), you can access your personal information by logging into your Account. If you do not have an Account, or are locked out of your Account, you can access your personal information contained in HT’s database by contacting us at [email protected]. If believe that any of your information is incorrect or needs updating, and you cannot make the change yourself within your Account, please let us know either at the email address listed in this section, or by U.S. Postal Mail to our address listed below (Attn: Information Access). HT will use reasonable efforts to correct your information and our records upon verification of the requested change. If you no longer wish to receive email or postal notifications about our Services, products, services or special promotions, please let us know by sending an email to [email protected] or by sending us a letter via U.S. Postal Mail at our address listed below (Attn: Opt-Out of Mailings) and specifying in the text of your email or letter which notifications you no longer wish to receive. In addition, within the text of your email or letter, you should provide your exact name and address so that we can do our best to ensure that you stop receiving the notifications that you no longer wish to receive. After such a request is received, HT will use reasonable efforts to refrain from including you when sending such notifications by noting your opt-out election in our database.

You decide what personal information you make available to other users of our Services, including in or on our chats, blogs, posts and other disclosures. All users of our Services should be aware that information you make available via these disclosures is public and not private. HT is not responsible for and cannot control the actions of others who will have access to this information, therefore, we do not and cannot guarantee that the information you disclose in this manner will not be viewed by unauthorized persons.

HT may provide security measures that are designed to restrict access to certain portions of the Services, such as private chat rooms and message boards, restricted forums, team areas or instant messaging, but HT cannot and is not responsible for circumvention of these security measures or for further distribution or use of any information you disclose in public areas by others. We may also provide you tools to edit and remove the information or materials you make available on our Services, but even after removal, copies of any information you post may remain viewable in cached, archived or otherwise saved media that is outside the control of HT. You are solely responsible for any information and materials that you choose to make available on public areas of our Services.

6. STORAGE AND TRANSFER OF INFORMATION

We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than two years past the termination of the user's account.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We aim to protect your personal information through a system of organizational and technical security measures. We have implemented appropriate technical and organizational security measures designed to protect the security of any personal information we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your personal information, transmission of personal information to and from our Sites or Apps is at your own risk. We may transfer, store, and process your information in countries other than your own. Our servers are located in the United States. If you are accessing our Sites or Apps from outside, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information, in and other countries. If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. 7. YOUR SOCIAL LOGINS

If you choose to register or log in to our websites using a social media account, we may have access to certain information about you.

Our Sites or Apps offer you the ability to register and login using your third party social media account details (like your Facebook or Twitter logins). Where you choose to do this, we will receive certain profile information about you from your social media provider. The profile Information we receive may vary depending on the social media provider concerned, but will often include your name, e-mail address, friends list, profile picture as well as other information you choose to make public.

We will use the information we receive only for the purposes that are described in this privacy policy or that are otherwise made clear to you on the Sites or Apps. Please note that we do not control, and are not responsible for, other uses of your personal information by your third party social media provider. We recommend that you review their privacy policy to understand how they collect, use and share your personal information, and how you can set your privacy preferences on their sites and apps.

8. COOKIES AND WEB BEACONS

Cookies are small data files that a website transfers to your browser when you visit a website. Web beacons are transparent pixel images that are used in collecting information about website usage, e-mail response and tracking. For the sake of ease, we use “Cookies” to describe both traditional cookies and web beacons.

We may use Cookies and other tracking technologies to collect and store your information. The use of Cookies is a standard practice among websites and online services. A Cookie is a small text file that is placed on your computer to uniquely distinguish your visit to a website or use of an online service. 9. YOUR PRIVACY RIGHTS

In some regions, such as the European Economic Area, you have rights that allow you greater access to and control over your personal information. You may review, change, or terminate your account at any time. In some regions (like the European Economic Area), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. Account Information: If you would at any time like to review or change the information in your account or terminate your account, you can log into your account settings and update your user account. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites or Apps.

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us using the details provided below. You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. 10. CONTACT BY HT

You do not have to participate in HT’s mailing lists (newsletters) in order to use the Services. However, if you elect not to receive such newsletters, you may miss valuable information on HT, its products and/or its services. HT will not contact you nor send you marketing materials unless you have accepted to receive such contact or information (i.e., you have not opted out).

11. USE BY MINORS

HT does not knowingly solicit or collect information from anyone under the age of 13. If you are opening an account on behalf of yourself, you represent that you are the age of majority in your jurisdiction and fully able and competent to agree to use the Services and access our Sites, including, but not limited to, our Apps. You affirm that you are 13 years of age or older, as the Service is not intended for, and we do not knowingly collect personal information from, children under 13. If you are between 13 and 18 years old, you may use the Service only with the involvement of a parent or guardian.

12. LINKS TO OTHER WEBSITES

Our Services may contain several links to or integrations with other websites whose information practices may be different than ours. Neither HT, nor any of its parent, officers, directors, partners, affiliates, subsidiaries, employees, agents, representatives, vendors or suppliers is responsible for the content, privacy policies, products, services, reliability, viewpoint or accuracy of information on any such websites. We do not control and are not responsible for the collection of personal information by third party websites, including websites owned or controlled by our preferred financial partners, advertisers, vendors and/or websites not controlled or authorized by HT. Third party websites that are accessed through links on our Service or integrations with other websites have separate privacy policies. We have no responsibility or liability for the policies implemented by third parties on their websites. You should contact those third parties directly to ask questions about their privacy policies.

If you enter or choose to leave our Services via links to other non-HT websites, your visits and actions on those websites are not covered by this Privacy Policy.

13. SECURITY

The security and confidentiality of your information is extremely important to us. We have implemented technical, administrative and physical security measures to protect your information from unauthorized access and improper use. HT makes access to your personal information subject to certain security measures, including technological controls such as “firewalls,” in accordance with industry standards. When the use of an HT web page involves the transmission of personal information or confidential information, HT may use Secure Socket Layer (“SSL”) technology to establish a secure connection between your computer and HT. HT reserves the right to monitor all network traffic to our Services to identify and/or block unauthorized attempts or intrusions to upload or change information or cause damage to any of our Services in any manner. Anyone using any of our Services expressly consents to such monitoring.

14. GOVERNING LAW / TRANSMISSION OF INFORMATION

Our Websites are controlled and operated from our offices within the State of Florida, United States of America. By choosing to visit or use our Services or otherwise provide information to HT, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the laws of the State of Florida as more fully set forth in our Terms of Use.

If you are accessing our Services from any location with regulations or laws governing personal data collection, use or disclosure that differ from United States laws or regulations, please note that through your continued use of our Services, which is governed by the laws of the State of Florida and the United States of America and this Privacy Policy, you are transferring personal information to the United States of America and you consent to that transfer to and any associated processing in the United States of America.

CHANGES HT has included the effective date of this Privacy Policy at the top and bottom of this policy. We reserve the right to make changes to any terms of this Privacy Policy at any time, however, we shall provide notification to you in advance of any changes becoming effective, such as by posting a notification on the Services, when you log into your account, or via email. If you continue to access and/or use any of the Services after the effective date of such changes, then such access and/or use will be deemed an acceptance of and an agreement to follow and be bound by the terms as changed.
